Types of Applications Being Filed at the Indian Patent Office
- Ordinary Application- It is a first application filed without a claim for any priority for an invention. In this application, the claims must be specified without any ambiguity. (In India, an option to file Provisional Application is also available)
- Convention Application- it is an application filed in one or more countries by the Paris convention which claims a priority based on the same or substantially similar invention(s). The application is supposed to be filed within 12 months from the date of the first application in the country which is part of the convention.
- Patent Cooperation Treaty (PCT) International Application- It is an application filed in confirmation with the Patent Cooperation Treaty (PCT). A PCT Application is supposed to be filed within 12 months of the Indian Filing (Priority) Date or by Foreign Filing License directly abroad by Section 39 of the Indian Patent Act.
- PCT National Phase Application- It is a global application that enters the Indian National Phase within 31 months from the date of Priority or International Filing whichever is earlier as the case may be.
Filing Requirements
- Full name, Address, Nationality of each Applicant and inventor;
- A copy of the Complete Specification, claims, abstract, and drawings (if any), in the English Language;
- Verified English translation of the priority document. The same can be submitted after Filing as well;
- A Power of Attorney signed by an Applicant or an authorized person of each applicant, in the original. The same can be submitted after Filing as well;
- Proof of Right i.e. evidence of transfer of rights from inventor to Applicant (It can be in Form 1 signed by all inventors or Notarized Assignment Deed). The same is supposed to be submitted within six months of the Indian Filing Date.

According to section 8 of the Indian Patent Act, the Indian Patent Office requires details of the Corresponding Applications filed outside India (which may include Name of Countries, Application Date and Number, Status of Application, Date of publication, etc.). Such Details are filed in Form 3 and are supposed to be filed within six months of the date of Indian Filing. Further, the applicant should inform the Indian Patent Office of any change in status within six months of any such change, for change of any status of such Foreign Application including any communication with the respective Patent Office.
Important Deadlines
- A Request for Examination must be filed within 48 months of the date of Priority or Filing, whichever is earlier. This application shall be examined only after publication. An Application shall ordinarily be published within one month from the date of expiry of 18 months from the date of Priority or Filing, whichever is earlier;
- Form 3 shall be filed within six months of any activity of any application filed abroad;
- A Working of invention statement must be filed by every patentee and licensee in Form 27 within three months of the end of each calendar year. The form shall contain information such as periodical statements about which the patented invention is used commercially in India
